ST. LOUIS (AP) - Greg Zuerlein kicked four field goals, including a 58-yarder and a club record 60-yarder, to help the St. Louis Rams to a 19-13 win over the Seattle Seahawks on Sunday.

Special teams led the way for the Rams (2-2), with a fake field goal turning into a 2-yard touchdown pass from punter Johnny Hekker to Danny Amendola to put St. Louis ahead 10-7 late in the first half.

The loss came six days after Seattle (2-2) beat Green Bay on a botched call by replacement officials on a final-play touchdown pass into the end zone. Regular officials were back this weekend.

Marshawn Lynch led Seattle with 118 yards on 20 carries, including an 18-yard score to cap the game's first possession.

The Rams intercepted Russell Wilson three times, with Bradley Fletcher clinching it with a pick at the Rams 25 with a minute to go.

Buying a Home without using an agent | Bay Area Real Estate Trends

This is very easy to do. You can simply call the listing agent and make an appointment to see a property if there isn?t an open house at a convenient time. Most listing agents are happy to write up your offer, it?s 50% more work for twice the commission. This is an inherently tricky situation, but not an inherently unethical one.

Alternatively, you can hire a Real Estate Attorney to write your offer and reduce the amount of your offer by 2.5% or 3%. This is not likely to work in a hot market or where the seller has more than one offer, why would a seller accept a non standard offer when they have a choice of standard, more likely to close offers?
I have a sentimental fondness for Patrick.net, it?s the first bubble site I found in early 2005. But the advice and comments often show a profound lack of understanding.

A while back Patrick said he?d hire an agent by the hour ?To just Chauffeur me around?? If you just need a chauffeur, have a friend drive you and buy them dinner. If you want a licensed person to drive you around and ?Kinda, sorta be my agent but not really?, oh boy.

Read up a bit on ?Ostensible Agency?. There?s LOTS of case law. I?m sure you could call around and find someone with a license who would be willing to do this for the median wage of $21.75 an hour or less. I wouldn?t get in a car driven by someone willing to do this because they are a leading candidate for a Darwin Award.

YMMV, but I do advise you to make your decisions on the basis of how things are rather than the way you wish they were.

Suicide bomber kills 2, injures 45 at Catholic church in Nigeria

BAUCHI, Nigeria (AP) ? A suicide car bomber attacked a Catholic church conducting Mass in northern Nigeria on Sunday, killing two people and wounding another 45 in a region under assault by a radical Islamist sect, officials said.

An Associated Press journalist heard the explosion after 9 a.m. Sunday in the city of Bauchi, which has seen a number of bombings and shootings blamed on the sect known as Boko Haram. The blast appeared to hit a parking lot alongside the St. John's Catholic Church in the city.

Police and military surrounded the church and did not allow journalists inside the cordon. Later at a nearby hospital, Bauchi deputy police commissioner T. Stevens told journalists told that the bomber had been stopped at the church's gate, where he detonated the explosives packed inside his car.

Doctors cautioned more could die from their injuries.

"The situation has been brought under control," Stevens said. "We have our men minding all areas."

Stevens said no group or individual had claimed responsibility for the attack, though suspicion immediately fell on Boko Haram. The sect, whose name means "Western education is sacrilege" in the Hausa language of Nigeria's north, has been waging an increasingly bloody fight against nation's weak central government. More than 680 people have died in drive-by killings and bombings blamed on Boko Haram this year alone, according to an AP count. The sect has demanded the release of all its captive members and has called for strict Shariah law to be implemented across the entire country.

The sect has used suicide car bombs against churches in the past, most noticeably a 2011 Christmas Day attack on a Catholic church in Madalla near Nigeria's capital. That attack and assaults elsewhere in the country killed at least 44 people. An unclaimed car bombing on Easter in Kaduna killed at least 38 people on a busy roadway after witnesses say it was turned away from a church.

Attacks against churches by the sect have waned in recent weeks. Nigeria's military claimed it killed the sect's spokesman and a commander Sept. 17 outside the city of Kano, potentially shaking up a sect that has continued attacks despite a tighter military presence in northern cities.

The killing of members of the sect's senior leadership comes as the group recently changed some of its tactics and attacked more than 30 mobile phone towers throughout northern Nigeria, disrupting communications in a nation reliant on cellular phones.

Saturday night, the military conducted door-to-door searches in the northern cities of Damaturu and Potiskum, areas now under a 24-hour curfew that have been hard-hit by the sect.

Oracle's 1Q earnings rise 11 pct despite sales dip

Oracle's earnings matched analyst estimates in the latest quarter, but a revenue decline signaled the business software maker is having a tougher time closing deals. FILE-This Monday, June 18, 2012, file photo shows the Oracle headquarters in Redwood City, Calif. Oracle's earnings matched analyst estimates in the latest quarter, but a revenue decline signaled the business software maker is having a tougher time closing deals. The fiscal first-quarter results announced Thursday, Sept. 20, 2012, are the latest indication that companies and government agencies are clamping down on technology spending amid mounting uncertainty about the economy. (AP Photo/Paul Sakuma, File)

(AP) ? Oracle joined a recent procession of technology companies that have stumbled in a shaky economy, but management's forecast for the next few months seemed to persuade investors the business software maker will quickly regain its stride.

The quarterly results announced Thursday provided the latest indication that companies and government agencies are clamping down on technology spending until they get a better sense of where the economy is heading.

The decision-makers in technology departments have been especially reluctant to invest in new personal computers and other expensive hardware. That trend has caused leading PC manufacturers such as Hewlett-Packard. Co. and Dell Inc., and a range of microprocessor makers to report disappointing numbers and bleak outlooks.

Oracle's specialty, though, is database software and applications that automate administrative tasks ? products that so far are still generating higher sales even in uncertain times. That helped Oracle boost its revenue from new software and online subscriptions by 5 percent from the same time last year, an encouraging sign because those licenses hatch more moneymaking opportunities in the form of future upgrades and maintenance fees.

In a particularly heartening sign, Oracle predicted its sales of software licenses and subscriptions in the current quarter will climb by 5 percent to 15 percent from the same time last year.

But Oracle is also trying to muscle its way into the computer server market, a foray punctuated by its $7.3 billion acquisition of Sun Microsystems in 2010. The expansion hasn't paid off yet, although Oracle executives have pledged it will prove to be a lucrative move. In its most recent quarter, Oracle's hardware revenue plunged 19 percent from the same time last year.

The erosion dragged down Oracle's overall numbers for its fiscal first quarter, a three-month period spanning from June through August. Like many U.S. companies that depend on overseas customers for a lot of their sales, Oracle was hurt by weakened currencies in Europe and other parts of the world. The currency fluctuations translated into fewer dollars during the latest quarter compared to a year ago.

Oracle Corp. earned $2.03 billion, or 41 cents, per share in the quarter. That's an 11 percent increase from net income of $1.84 billion, or 36 cents per share, at the same time last year.

Excluding certain accounting items, the company said it would have earned 53 cents per share, mirroring the average projection of analysts surveyed by FactSet.

Total revenue dipped 2 percent from last year to $8.18 billion. That was more than $200 million below analyst forecasts.

Oracle's fiscal first quarter is typically sluggish because it falls during the summer when deals are tougher to close because of vacations.

The sales decline in the past quarter might have been more worrisome if not for Oracle's projection for the current quarter ending in November. The company, which is based in Redwood Shores, Calif., foresees its revenue at worst remaining unchanged from last year and perhaps rising by as much as 4 percent.

Assuming Oracle's results come in at the mid-point of that forecast, the company's revenue in the current quarter will be about $9 billion. That's about $200 million under current analyst projections.

Excluding costs for past acquisitions and stock paid to its employees, Oracle expects its earnings in the current quarter to range from 59 cents to 63 cents. Analysts forecast 61 cents per share.

Oracle shares initially fell by as much as $1.21 in extended trading after the fiscal first-quarter numbers came out, but bounced back as investors digested the numbers and listened to management's heartening remarks. By late Thursday, Oracle's stock price had edged up 12 cents to $32.38 in extended trading.

Dutch Labor party surges in polls

AMSTERDAM (AP) ? With less than a week to go before national elections, an abrupt rise in the popularity of the brainy new leader of the Netherlands' Labor Party, Diederik Samsom, has conservative Prime Minister Mark Rutte suddenly fighting to hang on to his slim lead in the polls.

Neither candidate is seeking to radically alter the Netherlands' relationship with Europe, but Samsom, a former Greenpeace activist with an engineering degree in nuclear physics, has said he views Rutte's emphasis on austerity as misguided. If elected, he would de-prioritize spending cuts in the short term, investing more in education.

His slogan for Wednesday's vote: make the Netherlands "stronger and more compassionate."

The reason behind Samsom's rise is no mystery. Labor had been lagging in the polls until the first televised debate by the top four candidates last month, in which Samsom was able to position himself as the most reasonable alternative to Rutte.

The other top candidates were far-left Socialist Leader Emile Roemer ? a party with communist roots that has never participated in government ? and populist Geert Wilders, known for his anti-Islam stances and his calls for the Netherlands to withdraw from the euro-zone.

Samsom grasped the opportunity with both hands, displaying an understanding of policy nuances, acting humble, and criticizing his opponents for making unrealistic pledges. That style has continued to serve him well.

In an interview with De Telegraaf newspaper published Saturday, Rutte called Samsom "a danger for the Netherlands," and criticized his economic policies.

Rutte may be right to worry about Samsom's rise. According to pollster Maurice de Hond in a poll released Friday, a growing number of voters now view Samsom as a potential prime minister.

Socialist Party leader Roemer is widely liked but has not been seen as having the stature needed to rule. One popular news website routinely refers to him as "Fozzie Bear." Wilders' voters are intensely devoted, but his anti-Europe, anti-Islam rhetoric is not getting wider traction. Both candidates have lost ground in recent polls.

De Hond said that when voters were asked "who do you want to be prime minister if you can choose between Mark Rutte and Diederik Samsom?" 42 percent of respondents chose Rutte, while 47 percent chose Samsom.

After a decade of right and center-right governments in the Netherlands, left-leaning parties command a majority in most opinion polls, though they encompass many small parties. With a record 40 percent of voters still undecided less than a week before the election, if progressives begin to see Samsom as having a chance to beat Rutte, they may throw their support behind him.

Although Samsom was only elected Labor leader in March, he is a reasonably well-known figure in the Netherlands.

He has served in parliament since 2003, and his ability to perform well on television should not have come as a surprise, as he has been a serial victor on celebrity television quiz programs. In 2005 and 2006 he won "The National News Quiz," in 2008 he won "The National IQ Test" and the same year he won "The Big History Quiz."

His wife reportedly told him he had proved his point and should stop competing.

Samsom may also be benefitting from what voters don't know about him. Before entering politics, he worked for Greenpeace, where he was arrested several times, though he does not have a criminal record.

In an uncomfortable interview with a women's magazine in August he admitted being vain, unhappy about going bald, and having cheated on past girlfriends before meeting his wife. He is an atheist and a vegetarian.

"If you look at our platform, then the Socialist Party and Green-Left are our most obvious partners," he said in the interview with RTL television Friday. But he left the door open to forming a government with any party, including Rutte's, no matter how the vote turns out.

"The Socialists are saying they'll never help the right reach a majority, and Mark Rutte is saying he'll never help the left reach a majority," he said.

"If one more person puts a puzzle piece in the way, it may become impossible to form any governing coalition and that's the last thing this country needs."

People can be fat yet fit, research suggests. | someone somewhere

People can be obese yet physically healthy and fit and at no greater risk of heart disease or cancer than normal weight people, say researchers.

The key is being ?metabolically fit?, meaning no high blood pressure, cholesterol or raised blood sugar, and exercising, according to experts.

Looking at data from over 43,000 US people they found that being overweight per se did not pose a big health risk.

The results are published in the European Heart Journal.

In the study at the University of South Carolina, more than a third of the participants were obese.

Of these 18,500, half were assessed as metabolically healthy after a physical examination and lab tests.

This subset of metabolically healthy obese people who did not suffer from conditions such as diabetes, high cholesterol or high blood pressure, were generally fitter and exercised more than the other obese people.

And their risk of developing or dying from cardiovascular disease or cancer was identical to people of ideal weight and was half that of ?metabolically less fit? obese people.

These studies remind us that it is not always your weight that?s important, but where you carry fat and also how it affects your health and fitness?

Amy Thompson British Heart Foundation

Lead researcher Dr Francisco Ortega, who currently works at the University of Granada in Spain, said the findings show that getting more exercise can keep you healthier, even if you still carry a bit of extra weight.

?This research highlights once again the important role of physical fitness as a health marker.?

Most of the men and women in the study came from a similar background, meaning the results may not apply to everyone. They were mostly Caucasian, well educated, and worked in executive or professional positions.

Amy Thompson, of the British Heart Foundation, said: ?In the majority of cases, obesity is an undeniable risk factor for developing coronary heart disease. However, these studies remind us that it is not always your weight that?s important, but where you carry fat and also how it affects your health and fitness.

?It is particularly important to be aware of your weight if you are carrying excess fat around your middle. The fat cells here are really active, producing toxic substances that cause damage which can lead to heart disease.

?Maintaining a healthy diet with lots of physical activity can help to slim you down as well as reduce your risk of heart health problems.

?But don?t get too caught up on the numbers on the scale. Calculating your body mass index and measuring your waist are great ways to keep on track. If you are concerned about your weight and want to make changes to your lifestyle, make an appointment with your GP to talk it through.?

Scarlett Johansson urges young to get involved

(AP) ? Actress Scarlett Johansson is urging young people to make their voices heard by casting ballots in the 2012 election.

The star of "The Avengers" tells the Democratic National Convention that less than half of all eligible voters between 18 and 24 voted in the presidential election four years ago.

The 27-year-old Johansson says that major issues are at stake for her generation, including access to health care, affordable college tuition and the guarantee of equal pay.

Actress Kerry Washington spoke with Johansson on Thursday night and described herself as the granddaughter of Ellis Island immigrants who could not have afforded college without the help of student loans.

The 35-year-old Washington says that people who don't vote risk losing basic rights that their parents and grandparents fought for.

Try a little tenderness and your brain will tell

Wednesday, September 5, 2012

How would you respond if someone told you that you have a very dedicated son and that he got the scholarship he most wished? Or that the company you worked for made great profits and you will receive a good salary raise?

While the former situation represents a positive affiliative experience the latter is a non-affiliative one, and that, according to a paper published in tomorrow's issue of the Journal of Neuroscience, can make all the difference to the way your brain responds.

Affiliative experiences are inherent to humans and other mammals. It has been known for some time that mammals sustain social bonds by showing affiliative behavior, which promotes group cohesion and cooperation among members. Previous studies done in animals have pointed to specific regions in the brain involved in these behaviors.

In humans, the challenge has been to show how affiliative experience modulates brain activity and to distinguish these experiences from non-affiliative negative and positive emotions such as fear and sorrow or joy and pride.

In a paper entitled "A neural signature of affiliative emotion in the human septohypothalamic area" and published this week in the Journal of Neuroscience, a group led by Dr Jorge Moll at the Cognitive and Behavioral Neuroscience Unit at D'Or Institute, in Rio de Janeiro, Brazil, compared brain responses to affiliative and non-affiliative social scenarios associated with either positive or negative emotions.

The group, which also includes Dr Roland Zahn at the University of Manchester and the Manchester Academic Health Sciences Center at the School of Psychological Sciences in the United Kingdom, and other researchers from the Federal University of Rio de Janeiro, the State University of Rio de Janeiro and the Federal University of ABC, in Brazil, succeeded in designing an experimental set up using functional MRI in which affiliative experiences could be differentiated from emotional experiences that did not involve affiliation.

By presenting each of the 27 healthy volunteers with 280 social scenarios of five different types (affiliative positive, affiliative negative, non-affiliative positive, non-affiliative negative, and neutral) consisting each of two short sentences, the group asked each participant to rate the amount of positive or negative emotional experience associated with each scenario. When faced with scenarios such as "You were distracted and lost your young child in the park" (affiliative negative) or "You were blamed for a problem that was not your fault and lost your job" (non-affiliative negative) each participant was asked to rate the scenario using a scale ranging from very unpleasant to neutral to very pleasant. In addition, participants evaluated each scenario according to its degree of affiliation by rating the level of care or tenderness involved.

"Our study shows that the septal/preoptic-anterior hypothalamic area is the key region engaged by affiliative stimuli," says Dr Moll. The study also shows that this response was irrespective of whether the stimuli were emotionally positive or negative.

"The septal/preoptic-anterior hypothalamic area has been previously indicated as involved in attachment-related behaviors in other species but only now have we been able to show the existence of a neural signature of human affiliative experience," says Dr Ricardo de Oliveira-Souza, who also participated in the study.

The identification of the brain mechanisms associated with affiliative experiences is crucial for a deeper understanding of how our emotions are triggered, especially those that connect us to our loved ones. Additionally, these findings may bear direct implications for neuropsychiatric conditions in which affiliative experiences and behaviors are impaired, such as post-partum depression, psychopathy and attachment disorders.

Key Points for More Local Online Visibility | Local Internet Marketing ...

Due to the massive number of businesses fighting to capture the attention of consumers online, gaining online exposure is getting tougher every day. This means in order to get more eyes on their companies, small business owners today must focus on developing strategies that will put them right in front of their target audience.

One crucial strategy that provides results for businesses is the focus on ?local? visibility. Local SEO strategies are mostly used by companies who want to generate more local customers; therefore, local business owners should employ strategies that focus on getting more foot traffic and phone calls from people in their area.

There are several things that should be considered when running a campaign for more local visibility. Choosing the right keywords, choosing the appropriate strategies, and starting in the right pace all play a role in the success of your campaigns.

They should be incorporated into all of your marketing plans in order to have a complete system that will take your business to new levels.

The most important thing when it comes to Internet marketing and increasing webs presence is the use of keywords. People search for businesses using keywords and this means that they will find you easily if your marketing methods are focused around those same keywords.

Local visibility is all about location so the use of your city?s name in your content will go a long way in driving qualified traffic to your website and consequently increasing your income.

The process of increasing local visibility has its challenges, but with the right decisions, you can easily stand out from your local competitors. Prior to embarking on the process, you should first decide on the method you will utilize in your campaign. There are several methods which include, but are not limited to the use of local maps, organic strategies, local listings, paid and sponsored ads, and many others.

Some businesses make the mistake of thinking that they don?t need to use Internet marketing to grab attention from local consumers. This is not true. Local consumers go online to search for local products and services in their area, so you need to have a strong presence. Never underestimate the power of internet marketing. Even the smallest steps can produce amazing results when done with precision and intelligence. Visibility is all about putting yourself right in front of your target audience, which ultimately delivers more leads, sales and profits to your business.

Biden: Romney ready for war with Syria, Iran

(AP) ? Vice President Joe Biden said Sunday that Republican rival Mitt Romney is "ready to go to war in Syria and Iran" while hurting the middle class.

The warning came during a campaign stop in York, Pa., designed to promote President Barack Obama's economic policies among white, working-class voters. The thrust of Biden's pitch has been that America is digging out from the 2008 economic collapse and that Romney would take the country backward. But Biden, a foreign policy heavyweight, also cautioned voters that Romney would adopt policies that favor confrontation over cooperation.

"He said it was a mistake to end the war in Iraq and bring all of our warriors home," Biden said of Romney. "He said it was a mistake to set an end date for our warriors in Afghanistan and bring them home. He implies by the speech that he's ready to go to war in Syria and Iran."

Biden made the claim about Syria and Iran without offering specifics; his campaign did not immediately respond to a request for details and he did not use similar language on Syria and Iran at a later stop in Green Bay, Wis.

Romney's campaign dismissed the criticism. "It's no wonder that a politician who has been wrong about every major foreign policy question of the last 30 years is wrong on every count about Gov. Romney's strategy to restore America's leadership role in the world," spokeswoman Amanda Hennenberg said.

Romney has said he would consider military action in Syria if the war-torn country's chemical weapons were at risk of falling into the wrong hands. Obama, who has opposed military action in Syria, has made similar remarks, calling it a "red line" for the U.S. if Syrian President Bashar Assad's regime were to use chemical or biological weapons.

And like Obama, Romney has said the U.S. must keep all options on the table, including a military strike, when dealing with Iran. But Romney has suggested that Obama has been too soft on Iran and ? without offering specifics himself ? said he would prevent Iran from obtaining a nuclear weapon.

But Biden's remarks, in an audience of about 1,400 in a high school gymnasium, focused mostly on the economy.

"This is no time to turn back. We have to continue to move forward," he said. "Folks, I am absolutely certain ? there's not a single doubt in my mind ? that we are on the way to rebuilding this country stronger than it was before."

Biden said Romney's policies favor the rich at the expense of the middle class.

"On top of maintaining that tax cut ... they want to add another $250,000-a-year tax cut for everyone making over a million dollars," Biden said. "So you wonder why they're eviscerating the middle class, and this has a giant price tag."

"These are the very policies that put America's greatness in jeopardy in the first place," he added.

He also noted Ryan had not told the complete story when he talked about a General Motors plant that closed in Janesville, Wis., his hometown.

"What he didn't tell you was that plant in Janesville actually closed while President Bush was still president," Biden said.

Later, in Ryan's home state of Wisconsin, Biden again challenged Ryan's criticism of Obama.

"He created a bipartisan debt commission. They came back with an urgent report. He thanked them, sent them on their way, and then did exactly nothing," Ryan said of Obama during his acceptance speech in Tampa.

Biden was having none of that telling.

"What he didn't tell you is he sat on that commission," Biden said to laughter.

"I love these guys. Oh, I love these guys, how they claim to care about the deficit," Biden went on. "Ladies and gentlemen, the thing I most love about them is about how they discovered the middle class at their convention. Isn't that amazing? All of a sudden their heart was bleeding for the middle class."

The Ordinary Life of an Extraordinary Girl: Educating Alex - the now

For these few weeks I am republishing the "Educating Alex" series I shared in 2009, 2010 and 2011. Since these are direct republishes there may be references to events?I wrote about during that time period. There have been challenges and growth since I began this journal, but it may be worthwhile to revisit our educational history. This is the ninth in a ten part series. The following was first published in June 2011 as an update to our high school years.

**********************************************************

For those of you who have followed Alex's year and my battles to incorporate inclusive opportunities in to?Alex's curriculum, you will know?I have been frustrated.? I have asked for peer groups for Alex and her peers to learn.?I have had to stay on top of the basketball coach so Alex is not excluded from playing in games. I have asked for modifications for academics?for Alex so she can participate in regular education classes, and the list goes on and on.

Sometimes I have been successful, but many times not. I do not mean to discredit the caring, skilled and passionate teachers Alex has, but rather the culture of a school district that is reactive and listens only to those who complain the loudest. For instance, I have wondered if the extra speech therapy I requested and received for Alex caused another child to receive less.

My goal is really quite simple, facilitate?situations for Alex where she is part of the high school community, where she feels welcomed and embraced for who she is, and what she has is secondary. Perhaps?I have big dreams, but why shouldn't I? Alex does.

I have worked with another Mom to create a SEAC (Special Education Advisory Council), our mission is to provide suggestions and recommendations to the School Administrators about special education improvements. As any parent of a child with special needs knows, some parts of our children's education are good and some parts can be better. As a committee, we have focused on professional development and in particular the lack of training all teachers receive in regards to students with IEPs.

I believe the administrators recognize this is an issue and is one of the many reasons I have had to battle?these past five years to?create a team philosophy of?educating Alex. However when we request these training opportunities for our teachers we are met with the following:

  • "We can't make?teachers attend training"
  • "Our principals say their teachers already know about IEPs"
  • "We don't have enough money"
And so on and so on.

Two years ago a new family moved to our valley. This family has the same issues I have, and in some ways worse. Like us they came from a school district that supported their daughter, and like us, have been disappointed and discouraged about the lack of supportive and inclusive opportunities in our High School.

However, unlike us they filed a litany of grievances against the school district. This is a time consuming and expensive process, and I am grateful this family had the time and resources to do this.

The following was in the Aspen Times on May 31.

Re-1 acknowledges discrimination, agrees to policy changes

Family hopes to 'make a difference for others with disabilities' in filing complaint

Jeanne McGovern

The Aspen Times

Aspen CO Colorado

BASALT ? When the Sakin family filed an official grievance against the Roaring Fork School District Re-1 for discrimination against their disabled child this year, they knew it wouldn't win them any friends. But the Basalt residents believed they had no other recourse in a situation they say was becoming increasingly intolerable ? and ?totally unacceptable? ? for their high school daughter.

?We did not take this action lightly,? said Sally Sakin. ?But it got to a point where something had to be done. Something had to force a change. If not for Arden, for all the other kids who are discriminated against, all the other kids who might follow in her footsteps.?

Arden will finish her junior year at Basalt High this week. She knows she won't return to a perfect environment next year, but she hopes a few things will change.

?It's been hard, very hard,? said Arden, who has cerebral palsy, an autoimmune disorder and learning disabilities but manages to keep up a full class load, participate in extracurricular activities and generally embrace life. ?But what's been happening is wrong. It is just so bad; someone had to see what was happening.?

In fact, Re-1 acknowledged six different violations against Arden, ranging from not making areas accessible for her motorized scooter to not providing physical therapy as outlined in her Individualized Education Program (IEP) to ?different treatment? by some school personnel.

As a result of these violations, the Re-1 Board of Education on May 18 agreed to a 12-point ?corrective action? plan. Among the measures set forth in the plan are several ?appropriate personnel? actions that were not made public, as well as training for district personnel at all levels ? from case managers and principals to teachers and instructional staff ? on how to comply with the law in regard to disabled students.

?The Roaring Fork School District, in conjunction with Mountain BOCES, took these allegations seriously and investigated this matter thoroughly,? Re-1 Assistant Superintendent Brad Ray said in an email statement. ?Concluding the investigation, the Board of Education adopted a resolution to address the allegations and the district is committed to upholding this agreement.

?The sensitivity and confidentiality of all parties involved in this investigation is one of our main concerns and objectives. I would like to thank all parties involved in this process and believe the outcome will be a betterment for our district as a whole.?

The Sakins, while similarly disinclined to point fingers, were clear to note that the discrimination against their daughter was widespread, and included students, parents, teachers and administrators.

?Don't get me wrong, we do have some incredible advocates in the schools,? said Sakin, adding that once the grievance was filed the district was proactive in its investigation and recommendations. ?But, by and large, the feeling we got was that it was too burdensome to accommodate Arden, even though it was required by law. And that message trickles down from the top; and, ultimately, it's the message the students get.

?There is nothing about inclusion or compassion being taught. It is just sad to realize that some people don't even recognize that they are being discriminatory.?

Arden's story

Sakin said her family, which moved to the Roaring Fork Valley two years ago, tried everything to avoid filing the complaint: ?We waited a long time and we tried very hard to be conciliatory,? explained Sakin, adding that the family hired a special education attorney but chose to file an official grievance rather than a lawsuit through the Office for Civil Rights in an effort to promote change and cooperation. ?But nothing worked, nothing changed. And while that was OK for a while, it was just one thing after another and it eventually it became too much.?

According to Sakin, ?the straw that broke the camel's back? was when Arden was essentially barred from participating in the school musical.

Arden, who is passionate about music and dance, auditioned for ?West Side Story? like dozens of other students. But within moments of being on the stage, she was essentially dismissed. No one ? from the students to the teachers to the show's organizers ? tried to accommodate or accept Arden's need to ?dance differently.?

?There was no dialog, there was no effort to try and make this work for Arden,? said Sakin, a fierce advocate not only for her daughter but for all the disabled. ?Arden wanted this so badly and she was deflated. Not because she didn't make the cut, but because she wasn't even given a real chance.?

It is a story Sakin says she's heard over and over in the local schools ? disabled kids whose needs are not being met, or whose needs are being brushed aside.

It is little consolation to Arden, who, in many ways, is just like other high schoolers. She carries a full class load, she monoskis, she volunteers in the community, she is a budding entrepreneur and she has two summer internships. And, like other high school students, she wants to fit in, to wants find her niche, wants to be a friend and have friends. It hasn't been easy.

?It's been awful. I've never been around such rude and ignorant people,? she said, sharing stories of friends from her former school and acquaintances from her globetrotting adventures. ?I've tried so hard to be positive, to make it work.

?But it just wouldn't change. I feel like I am all alone.?

Her mother agreed: ?At the end of the day, we just felt that nobody recognized how hard Arden worked, how difficult it has been. Nobody gave her the kudos she deserves.?

What happens next?

Arden accepts the fact that the result of the grievance complaint might only hurt her situation. Her parents accept this, too. But they believe the outcome is worth the risk.

And though several of the specific grievances filed in the 23-page report could not be corroborated by the school district, and were thus not found to be violations, Basalt High ? and, by default, the entire Re-1 school district ? is under the microscope.

?Our goal is to change things for people with special needs. This is a step toward that goal,? said Sakin, adding that if the corrective action plan is not followed, the family would consider further legal action. ?Now it is out there; it is public and it cannot be brushed under the rug again.?

But more than the formality of the grievance and the resulting plan, the Sakins hope they have made a small dent in the discrimination against the disabled. They hope they have opened a few eyes to what is really happening in our local schools.

?This will not specifically change life for Arden, but it could change life for people who come through these schools after her. We are hopeful that this will be the case,? Sakin said. ?And we will be watching.?

I have a few?thoughts in regards to these grievances:

First and foremost, kudos to our school district for recognizing these grievances were valid and proposing a plan of corrective measures. And secondly, why couldn't this have happened outside the law, why did it take money and a lawyer to?enact a plan for change? Where is our community, our educators and our families, why did this have to go so far? And of course, thanks to the Sakin Family for doing something we could not.

Details of corrective actions will follow as they are disclosed!

Closing arguments set to start in Peterson trial

FILE - This May 7, 2009 file photo provided by the Will County, Ill., Sheriff's office shows former Bolingbrook, Ill., police officer Drew Peterson. Peterson is charged with first-degree murder in the 2004 drowning death of his former wife Kathleen Savio. He has pleaded not guilty. (AP Photo/Will County Sheriff's Office, File)

(AP) ? Attorneys deliver closing arguments at Drew Peterson's trial Tuesday, after which jurors will begin deliberations on whether the state proved the former Illinois police officer murdered his third wife.

The sides make their final pitches after five weeks of testimony about the 2004 death of Kathleen Savio, whose body was found in a dry bathtub of her suburban home outside Chicago with a gash on the back of her head.

The 40-year-old's death was initially ruled to have been an accident. Only after Peterson's fourth wife, 23-year-old Stacy Peterson, went missing in 2007 was Savio's body exhumed and her death reclassified as a homicide.

Prosecutors will argue circumstantial evidence points to just one plausible explanation for Savio's death: that Peterson killed her. The defense will say not only is there no evidence tying Peterson to Savio's death, the state hasn't even proven that her death was murder.

Chris Koch delivers the state's closing, and Will County State's Attorney James Glasgow will do the rebuttal ? essentially the last word to jurors. The normally stone-faced Glasgow has shown flashes of anger at the trial, arguably the biggest of his career.

Closing for the defense is Joe Lopez, known for his brightly colored ties and aggressive, blunt courtroom style.

Peterson, 58, has pleaded not guilty to first-degree murder. If convicted, he faces a maximum 60-year prison sentence.

Prosecutors have been barred from telling jurors Stacy Peterson is presumed dead or that her husband is the lone suspect in her disappearance during testimony ? and they can't allude to it during closings.

Among the challenges for the prosecution will be to spell out clearly how jurors can convict Drew Peterson absent any physical evidence and with not a single witness placing him at the scene of the alleged crime.

The heart of the state's case is normally barred hearsay ? statements Savio made to others before she died and that Stacy Peterson made before she vanished. Illinois passed a law in 2008, dubbed "Drew's Law," allowing hearsay at trials in rare circumstances.

The hearsay in the prosecution's four-week presentation of 30-plus witnesses included friends and relatives of Savio who testified that Savio told them Peterson could kill her and make it look like an accident.

Prosecutors on Tuesday are also likely to remind jurors of testimony from Stacy Peterson's pastor, Neil Schori, who said she told him her husband got up from bed and left the house in the middle of the night around the time of Savio's death.

As part of their three-day case, Peterson's lawyers called Peterson's and Savio's 19-year-old son, Thomas Peterson, to tell jurors he has never believed his father killed his mom.
